Can UK Citizens Still Buy Property in Spain After Brexit?
Yes. Brexit changed how the UK is treated for immigration purposes, but it never touched the right to buy, own, or sell property in Spain. Here’s what actually shifted, and what didn’t.
The short answer
Property ownership rules in Spain have never been limited to EU citizens — buyers from all over the world purchase here, Brexit or not. What changed for UK nationals is their immigration status, not their property rights. In practice, that means the paperwork trail and the residency picture look a little different than they did before 2020, but the purchase itself is fully open to British buyers.
What changed after Brexit
- Visitor time limits — UK citizens are now subject to the same stay limits as other non-EU visitors across Spain and the wider Schengen area, which matters if you plan to spend long periods at the property
- No residency shortcut from buying — purchasing a property doesn’t itself grant any right to live in Spain beyond the standard allowance for visitors
- Some extra paperwork — certain steps in the process, particularly around financing, can ask for slightly different documentation from UK nationals than before
What didn’t change
- The right to buy — there’s no restriction on UK citizens purchasing property in Spain
- The right to own and sell — existing and future UK-owned properties are unaffected
- The basic purchase process — the core steps (tax ID, notary, registration) are the same framework every foreign buyer goes through
